1. Agreement to Terms

These Terms of Service constitute a legally binding agreement between you and PepeWebTech, operated by Josue Zazueta, sole proprietor based in Temecula, California. By accessing our website or purchasing any service, you agree to be bound by these terms. If you do not agree, do not use our services.

2. Services

PepeWebTech provides the following services:

• AI Employee Services — AI-powered chatbots, phone agents, and follow-up systems configured for your business.
• Website Design — Landing pages, business websites, and e-commerce solutions built to specification.
• Consulting — Technology consulting and strategy for small businesses.

Specific deliverables, timelines, and pricing are defined in individual proposals, contracts, or subscription agreements.

3. Subscriptions and Billing

• AI Employee services are billed monthly. Payment is processed via Stripe at the start of each billing cycle.
• Website design projects require a deposit as specified in your proposal. Final payment is due upon project completion.
• You may cancel a monthly subscription at any time. Cancellations take effect at the end of the current billing cycle. No partial refunds are issued for mid-cycle cancellations.
• Prices are subject to change. Existing clients are notified at least 30 days before any price increase.

4. Client Responsibilities

You agree to:

• Provide accurate and timely business information needed to configure your AI Employee or website.
• Maintain the accuracy of FAQs, pricing, scripts, and other training content you provide.
• Use AI Employee services in compliance with applicable laws, including California AB 2905 (AI voice call disclosure) and SB 243 (chatbot disclosure).
• Not use our services for fraudulent, abusive, or illegal purposes.

5. Intellectual Property

Upon full payment, you own the website we design for you, including source code and visual assets created specifically for your project. PepeWebTech retains the right to display completed work in our portfolio and case studies unless you request otherwise in writing.

You retain ownership of all business information, training data, and content you provide. PepeWebTech retains ownership of proprietary tools, frameworks, and methodologies used in service delivery.

6. AI Service Limitations

AI Employee services rely on third-party AI model providers and telephony infrastructure. PepeWebTech does not guarantee uninterrupted availability or 100% accuracy of AI-generated responses. We are not liable for damages resulting from incorrect or inappropriate AI responses when you have been provided the ability to review and update training content.

7. Refund Policy

• Monthly AI Employee subscriptions are non-refundable once a billing cycle has started. Cancel before the next cycle to avoid charges.
• Website design deposits are non-refundable once work has begun. If a project is cancelled mid-development, you receive all completed deliverables up to the cancellation date.
• If PepeWebTech fails to deliver agreed-upon services, you may request a proportional refund for undelivered work.

8. Limitation of Liability

PepeWebTech is not liable for indirect, incidental, special, consequential, or punitive damages arising from the use of our services. Our total liability for any claim is limited to the amount you paid us in the 30 days preceding the event giving rise to the claim.

9. Confidentiality

We treat your business information, training data, and call recordings as confidential. We do not share your data with third parties except as necessary to deliver services (e.g., AI model providers, telephony). See our Privacy Policy for details.

10. Termination

We may suspend or terminate services immediately if you violate these terms, engage in illegal activity, or fail to pay for services. You may terminate any subscription by providing written notice via email. Upon termination, we delete service data within 30 days unless you request otherwise.

11. Changes to These Terms

We may update these Terms of Service at any time. Material changes are communicated to active clients by email at least 14 days before taking effect. Continued use of our services after changes take effect constitutes acceptance of the updated terms.

12. Governing Law

These terms are governed by the laws of the State of California. Any disputes shall be resolved in the courts of Riverside County, California.
